Terms of sale

Article 1 — Purpose and scope
These terms and conditions of sale govern, without restriction or reservation, all sales concluded on the site Cascades & Sens between the seller identified in article 2 and any non-trading natural person acting for purposes outside their professional activity, hereafter "the Customer".
They are made available on the site and accepted by the Customer before the order is confirmed, by means of a tick box. This acceptance is a condition of the order. The applicable version is the one in force on the day of the order.
Sales are reserved for persons of legal age with legal capacity. We reserve the right to refuse any order that is abnormal or manifestly fraudulent.

Article 3 — Products
The products offered are those appearing on the site on the day it is consulted, while stocks last. Each product page states the essential characteristics of the item.
3.1 Natural stones and minerals
Stones and minerals are natural materials : shade, veining, inclusions, dimensions and weight vary from one piece to another. Photographs are representative of the item, but the piece received may legitimately differ from the one photographed. These variations are inherent to the nature of the product and do not constitute a lack of conformity.
3.2 Nature of the products and absence of health claims
The products sold are decorative and wellbeing objects. The virtues, symbolism or traditional uses mentioned in the descriptions belong to beliefs and traditions, reported on a cultural and informational basis.
They are neither medicines, nor medical devices, nor food supplements. They have no therapeutic, curative or preventive properties and can in no case replace medical advice, a diagnosis or a treatment. If you have a health problem, consult a healthcare professional.
3.3 Precautions of use
Candles and incense are combustible products: never leave them burning unattended, keep them out of reach of children and animals, place them on a heat-resistant surface and ventilate the room. Small items (beads, tumbled stones) may present a choking hazard for young children.
Article 4 — Prices
Prices are shown in euros, all taxes included, excluding shipping. As the seller benefits from the small-business VAT exemption (article 293 B of the French General Tax Code), no VAT is charged and none is recoverable.
Shipping costs are indicated before the order is finally confirmed and repeated on the confirmation. Prices may be changed at any time; the applicable price is the one displayed at the time the order is confirmed.
Article 5 — Ordering
The ordering process involves the following steps:
- selecting items and adding them to the cart;
- checking the order details, the total price and the shipping costs;
- entering contact details and the delivery address;
- accepting these terms and conditions of sale;
- confirmation and payment — this step constitutes conclusion of the contract and an obligation to pay.
Before confirming, the Customer may go back to each step and correct any errors. A confirmation email summarizing the order is sent without delay to the address given.
The computerized records kept by the seller and its payment provider are considered proof of the communications, orders and payments that took place.
Article 6 — Payment
Payment is made in full on the day of the order, by the means offered at checkout (bank card and other displayed solutions). Payment data is transmitted directly to the payment provider: the seller has access to no bank card number whatsoever.
The order is only processed after payment has actually been received. If authorization is refused, the order is automatically cancelled.
Article 7 — Delivery
7.1 Zones and times
Orders are prepared and shipped from a warehouse located in Spain (European Union).
- Mainland France — €7.99 — delivery within 3 to 7 business days from dispatch. Free shipping on orders from €65.
- European Union — €22.00 — delivery within 5 to 12 business days.
- Overseas territories, Monaco and Andorra (Guadeloupe, French Guiana, Martinique, Mayotte, Réunion, French Polynesia, New Caledonia, Wallis and Futuna, Saint Barthélemy, Saint Pierre and Miquelon, Monaco, Andorra) — €29.00 — delivery within 10 to 20 business days.
- International (Switzerland, Norway, United States, Canada, Japan, South Korea, Singapore, Malaysia, Hong Kong, Israel, United Arab Emirates, Australia, New Zealand) — €29.00 — delivery within 10 to 20 business days.
These times run from dispatch and exclude public holidays. The maximum delivery period, within the meaning of article L216-1 of the French Consumer Code, is thirty (30) days from the conclusion of the contract.
7.2 Late delivery
If the stated delivery date is exceeded, the Customer may require the seller, by registered letter with acknowledgement of receipt or in writing on another durable medium, to deliver within a further reasonable period. Failing performance within that new period, they may terminate the contract by the same means. The contract is then terminated on receipt of that notice and the sums paid are refunded at the latest within the following fourteen (14) days (articles L216-6 and L216-7 of the French Consumer Code).
7.3 Receiving the parcel
It is recommended to check the condition of the parcel on delivery. In the event of damage or a missing item, the Customer must record precise reservations with the carrier and inform us at manondecascadesetsens@gmail.com within three (3) working days, attaching photographs. This step makes handling easier but is not a condition of exercising the legal guarantees set out in article 9.
7.4 Customs duties and import taxes
For destinations outside the customs territory of the European Union — in particular Switzerland, Norway, Andorra, the United States, Canada, Japan, South Korea, Singapore, Malaysia, Hong Kong, Israel, the United Arab Emirates, Australia and New Zealand — the order may give rise to customs duties, import taxes and clearance fees. These amounts are included neither in the displayed price nor in the shipping costs: they remain entirely payable by the Customer, who is also responsible for complying with the import regulations of their country. Refusal to pay these charges, resulting in the return or destruction of the parcel, does not give rise to any refund of shipping costs.
The French overseas departments and regions — Guadeloupe, French Guiana, Martinique, Mayotte and Réunion — are part of the European Union but excluded from its VAT territory. Shipments sent there are subject tooctroi de mer and to local import taxes, which remain payable by the Customer on the same terms.
The French overseas collectivities — French Polynesia, New Caledonia, Wallis and Futuna, Saint Barthélemy and Saint Pierre and Miquelon — lie outside the customs and tax territory of the European Union. Shipments sent there may incur local import duties and taxes, which remain payable by the Customer.
Shipments to Monaco give rise to no additional duty or tax: the Principality falls within the French customs and tax territory.
Article 8 — Right of withdrawal
8.1 Principle and period
In accordance with articles L221-18 and following of the French Consumer Code, the Customer has a period of fourteen (14) calendar days to exercise their right of withdrawal, without having to give a reason or bear any penalty.
This period runs from the day on which the Customer, or a third party designated by them, takes physical possession of the goods. Where an order covers several goods delivered separately, the period runs from receipt of the last item. If the period expires on a Saturday, a Sunday or a public holiday, it is extended to the next working day.
8.2 How to withdraw
The Customer notifies their decision by an unambiguous statement, sent by email to manondecascadesetsens@gmail.com or by post to the address given in article 2. They may use the model form reproduced in article 8.6, without obligation. For the period to be met, it is enough that the notice is sent before the fourteen days expire.
8.3 Returning the goods
The goods must be sent back without undue delay and at the latest fourteen (14) days after the notice, to the following address:

The direct cost of returning the goods is borne by the Customer. They are advised to keep proof of dispatch and to choose a tracked service: the risk of loss or damage during the return carriage falls on them.
The goods must be returned in a condition allowing resale, with any accessories and packaging. The Customer may be held liable for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the goods (article L221-23 of the French Consumer Code).
8.4 Refund
The seller refunds all sums paid, including standard shipping costs, at the latest fourteen (14) days from recovery of the goods or from the Customer providing proof of dispatch, whichever occurs first.
If the Customer expressly chose a more expensive delivery method than the standard one, only the cost of the standard method is refunded. The refund is made by the same means of payment as the one used for the order, unless expressly agreed otherwise, and free of charge.
8.5 Exceptions
In accordance with article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for:
- goods made to the Customer's specifications or clearly personalized (engraving, made-to-measure composition);
- goods which, having been unsealed after delivery, cannot be returned for reasons of hygiene or health protection (opened cosmetic or bath products);
- goods which, after delivery, are inseparably mixed with other items;
- digital gift cards whose code has been sent.
8.6 Model withdrawal form

Article 9 — Legal guarantees
The Customer is informed that, independently of any commercial warranty, they benefit:
from the legal guarantee of conformity (articles L217-3 to L217-20 of the French Consumer Code), which allows them, in the event of a lack of conformity appearing within two years of delivery of the goods, to obtain the bringing of the goods into conformity by repair or replacement, or failing that a price reduction or termination of the sale. They are exempt from proving the existence of the defect during the twenty-four months following delivery. This guarantee applies with no cost for return, labor or parts. Where goods are repaired, the repaired goods benefit from a six-month extension of the guarantee;
from the legal guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code), which allows them, for two years from the discovery of the defect and within twenty years of the sale, to obtain termination of the sale or a price reduction.
To invoke either of these guarantees, simply write to manondecascadesetsens@gmail.com describing the defect and attaching photographs together with the order reference. We reply within 48 business hours and cover return costs where the guarantee applies.
The natural variations of shade, veining or dimension proper to stones and minerals, described in article 3.1, do not constitute a lack of conformity.
Article 10 — Liability
The seller is liable as of right for the proper performance of the contract, including where performance is entrusted to a service provider (article L221-15 of the French Consumer Code). She may be released from liability by proving that the failure to perform is attributable to the Customer, to the unforeseeable and insurmountable act of a third party outside the contract, or to a case of force majeure.
The seller cannot be held liable for the use the Customer makes of the products, nor for the consequences of use that does not comply with the precautions set out in article 3.3.
Article 11 — Personal data
The data collected when ordering is necessary to process the order and is kept under the conditions described in our Privacy Policy, which also sets out the rights available to the Customer and how to exercise them.
Article 12 — Intellectual property
All elements of the site remain the exclusive property of the seller or her rights holders. Nothing in these terms may be construed as granting a licence or right of use over those elements.
Article 13 — Complaints, mediation and disputes
Any complaint must be addressed first to manondecascadesetsens@gmail.com. We undertake to reply within 48 business hours and to seek an amicable solution.
If the answer given does not satisfy you, or in the absence of a reply within two months, you may refer the matter free of charge to the consumer mediator we come under:

The mediator may only be contacted within one year of your written complaint. Recourse to mediation is optional and does not prevent legal proceedings.
These terms are governed by French law. In accordance with article 6 of Regulation (EC) No 593/2008, this choice does not deprive the Customer of the protection afforded by the mandatory provisions of the law of their country of habitual residence. Failing an amicable settlement, the dispute may be brought before the competent court under the ordinary rules of law.
Article 14 — Miscellaneous
Should any of these provisions be declared void or unenforceable, the others retain full effect. Failure to rely on a clause does not amount to waiving the right to rely on it later.
These terms are drafted in French. In the event of translation, only the French version is authoritative.
